Timothy R. Herman
Timothy R. Herman focuses on business litigation and employment disputes.
Tim has successfully tried multiple cases, including a two week federal jury trial, defended and prosecuted temporary restraining order and preliminary injunction hearings, and has significant experience in all aspects of litigation including mediation and arbitration through the American Arbitration Association, at trial and on appeal. His litigation practice covers such diverse areas as shareholder disputes, non-competition and non-solicitation disputes, class action litigation, complex supplier disputes, equipment leasing matters, real estate litigation, legal malpractice actions, product liability defense and mechanic’s lien actions. He also represents corporate creditors protecting their rights in bankruptcy proceedings.
Tim has gained experience in defending technology companies and other businesses sued under the Illinois Biometric Information Privacy Act and other privacy-related cases. He has also defended companies in patent litigation and trademark disputes.
Tim has experience representing corporate and individual fiduciaries in matters involving claims of undue influence, lack of capacity, fraud, and duress and other disputes between beneficiaries of wills and trusts. Tim also has significant experience in post-judgment proceedings, including litigating fraudulent transfers and citations to discover assets. Tim also has experience in transactional matters, including analyzing and drafting employment and corporate maintenance agreements, contracts and assisting in corporate formation for small to medium-sized businesses and other start-up companies. He utilizes his litigation background to develop strategies to prevent litigation from occuring.
In August 2018, Tim attended a week-long trial academy through the International Association of Defense Counsel (IADC) at Stanford University in Palo Alto, California with some of the country’s leading trial lawyers. The 2018 IADC Trial Academy provided Tim with extensive instruction on opening and closing statements, direct and cross-examinations of lay witnesses and experts, and other trial technology tools.
In June 2018, Tim gave a presentation, “The Role of the Company Accountant in a Shareholder/Member Dispute: Minefields and Recommendations,” to 40 certified public accountants at BMO Harris Bank through Paychex’s yearly continuing, professional education program.
Tim also devotes significant time to pro bono causes, including obtaining the requisite findings in state court to allow minor children to become legal permanent residents in the United States by virtue of their status as Special Immigrant Juveniles.
