Timothy R. Herman is a trial lawyer with a national practice who focuses on high stakes business litigation, class action defense, and consumer litigation defense.

Tim has successfully tried multiple cases, including a two-week federal jury trial, multiple bench trials, numerous arbitrations before the American Arbitration Association and J.A.M.S., defended and prosecuted temporary restraining order and preliminary injunction hearings, and has significant experience in all aspects of litigation, including mediation, evidentiary hearings, and on appeal. His litigation practice covers such diverse areas as consumer litigation defense, shareholder disputes, non-competition and non-solicitation disputes, class action defense, complex supplier disputes, equipment leasing matters, real estate litigation, product liability defense, and the defense of technology companies that connect consumers with businesses. He also represents corporate creditors protecting their rights in bankruptcy proceedings and defending entities sued in adversary actions. He has also been admitted pro hac vice in numerous state, federal, and bankruptcy courts throughout the country.

Tim has gained experience in defending technology companies and other businesses sued under the Illinois Biometric Information Privacy Act as well as class actions alleging data breaches and other cyber incidents, privacy-related torts, and consumer class-wide arbitrations. He has also defended companies in high-stakes personal injury cases on behalf of gig economy businesses.

Tim has experience representing corporate and individual fiduciaries in matters involving claims of undue influence, lack of capacity, fraud, and duress and other disputes between beneficiaries of wills and trusts. Tim also has significant experience in post-judgment proceedings, including litigating fraudulent transfer claims and citations to discover assets. Understanding that litigation is sometimes a last resort for clients, he utilizes his litigation background to develop strategies to prevent litigation from occurring in the first place.

In 2018, Tim attended a week-long trial academy through the International Association of Defense Counsel (IADC) at Stanford University in Palo Alto, California with some of the country’s leading trial lawyers.

In June 2018, Tim gave a presentation, “The Role of the Company Accountant in a Shareholder/Member Dispute: Minefields and Recommendations,” to 40 certified public accountants at BMO Harris Bank through Paychex’s yearly continuing, professional education program. Tim is also the author of Ch. 4 Motions, Affidavits, and Orders for the Illinois Institute of Continuing Legal Education (IICLE ®, 2023) and the author of the upcoming Ch. 6, Voluntary and Involuntary Dismissals (IICLE ®).
