The Clark Hill Environmental and Natural Resources Litigation team, which includes trial lawyers and prosecutors from State Attorneys General, U.S. Department of Justice, and U.S. Environmental Protection Agency, provides experienced defense and prosecution of environmental claims in state and federal courts and before administrative law judges. Our team litigates matters arising under all major environmental statutes and regulatory programs. We represent clients in enforcement actions, administrative law challenges to agency actions, environmental indemnities and cost recovery claims under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and similar state statutes, natural resource damages litigation, and similar matters.

Our Environmental and Natural Resources Litigation team represents clients in a wide variety of matters, including:

  • Government Enforcement Defense actions brought by federal, state, and local authorities under water, air, waste, and other environmental regulatory programs, including actions to impose civil and criminal penalties and fines, negotiation of compliance orders and settlements, response to information requests and notices of violation, and other similar matters.
  • Administrative Litigation including challenges to agency rulemakings, defense of permit approvals, and defense of administrative orders and penalty assessments.
  • CERCLA Cost Recovery and Contribution Litigation including defense and prosecution of cost recovery and contribution on behalf of groups of potentially responsible parties (PRP Groups) and individual entities.
  • Natural Resource Damages Litigation arising from natural resource damage claims, corrective action orders, and cost recovery actions, including matters under CERCLA, the federal Oil Pollution Act, and similar state statutes.
  • Private Party Actions and Citizen Suits arising under federal and state environmental statutes, common law, contract claims, class actions, and complex multidistrict litigation of personal injury and property damage claims.
