Christopher Lucca has a diverse civil practice that has included the representation of Fortune 500 companies, small businesses, and individuals in business tort claims, contractual and employment disputes, and complex personal injury matters. He has experience in all facets of litigation, from independently conducting pre-suit investigations through trial.

Chris represents individuals and companies in contractual disputes, including the enforcement of equity agreements, indemnity provisions, and restrictive covenants. He has experience litigating disputes between small business owners, including those alleging the mismanagement of company assets and breaches of fiduciary duties. He also has experience with insurance disputes, including those claiming bad faith, and with catastrophic personal injury actions, including wrongful death claims.

Chris focuses his employment litigation practice on defending individuals and employers against claims of discrimination, retaliation, harassment, and unfair pay practices. He routinely counsels companies, as well as their executives and HR employees, on compliance issues, reductions in force, severance agreements, employment agreements, hiring guidelines, and personnel-related documents. He also discreetly pursues and negotiates the resolution of pre-litigation employment disputes.

Chris also has a professional liability practice that involves the representation of attorneys and law firms in legal malpractice actions. He has experience litigating complex claims of transactional malpractice, conflicts of interest, and professional negligence.

Chris is frequently engaged to serve as local counsel for matters in the Philadelphia area and routinely advises co-counsel about local rules, procedures, and best practices. He prides himself on balancing creative and practical strategies to achieve optimal litigation results, including avoiding the need for litigation altogether.

Commercial, Fiduciary, and Other Litigation

  • Represented former head of a life sciences company in private arbitration involving valuation of client’s equity interest following termination.
  • Achieved dismissal of private equity client from a wrongful death case brought in federal court where plaintiff sought to exercise jurisdiction over client through an alter ego/control theory based on our client’s controlling investment in a company.
  • Represented a business owner in lawsuit brought by purported members of the business against allegations of business ownership, mismanagement of assets, and breaches of fiduciary duty.
  • Represented an international automobile manufacturer in consumer class action defect cases brought in federal court.
  • Served as counsel to court-appointed federal equity receiver in ancillary litigation to an SEC enforcement action proceeding in the District of New Jersey, arising from an investment advisory fraud involving over $60 million in investor losses.
  • Worked as part of a trial team of lawyers defending multinational logistics company in complex litigation brought across the USA.
  • Represented a pharmaceutical company in several cases involving allegations of deceptive marketing and distribution of prescription drugs.
  • Represented several Philadelphia law firms and their shareholders in legal malpractice actions.
  • Represented the CEO of a pharmaceutical company in the defense of a securities fraud class action and a shareholder derivative lawsuit.
  • Represented a national insurance company in several cases alleging bad faith denial of insurance benefits.
  • Secured summary judgment on the interpretation of a cost-of-living provision in a long-term disability policy that had national implications for the company.
  • Secured summary judgment in commercial case brought in federal court as to the plaintiffs’ breach of contract, breach of fiduciary duty, conversion, aiding and abetting, and money had and received claims.

Employment Litigation

  • Advises a national business processing outsourcing company on employment issues and assists company in resolving pre-litigation employment disputes.
  • Defends companies in employment discrimination cases brought before administrative agencies and in state or federal courts.
  • Filed a trade secrets case in federal court for company arising out of an employee’s resignation and misappropriation of confidential and propriety information and negotiated return of company assets and consent order for injunctive relief.
  • Secured summary judgment for a religious institution on retaliation claims brought by former employee under Title VII and Equal Pay Act.
  • Successfully moved to compel arbitration in numerous employment cases filed in federal court.
  • Litigated several employment cases brought before the American Arbitration Association.
