Gary works closely with businesses and entrepreneurs to develop client-specific strategies to protect innovations in a wide range of industries, including automotive, agricultural, industrial, packaging, metallurgical, electrical, and cannabis. He collaborates with clients to assess the patentability of new inventions and to determine the scope of clients’ freedom to operate in select markets. Gary works to develop a strong understanding of his clients’ technologies to prepare and prosecute specific, tailored, and detailed patent applications before the U.S. Patent and Trademark Office (USPTO). He draws on an extended network of foreign and international associates to expand and protect clients’ portfolios around the world.
A growing area of Gary’s practice involves the use and implementation of artificial intelligence, generative AI, machine learning technologies, and (LLMs). He develops long-term intellectual property strategies to assist startups, inventors, and established companies in augmenting their businesses with AI-driven products, software innovations, automated workflows, and data-driven technologies. Gary regularly advises clients on how to responsibly use AI and LLMs to implement innovative processes and products while safeguarding their assets against inadvertent disclosure on open AI systems. He also helps clients frame their inventions and structure their patent applications to overcome the distinct challenges of AI patent prosecution, including questions of subject-matter eligibility.
Gary counsels clients regarding complex trademark matters, including determining brands’ eligibility for federal and state registration, strategies to protect against infringement, and overall management of trademark portfolios. He develops and implements strategies to protect, strengthen, and expand clients’ trademark rights, as well as assists clients with enforcing established marks against infringement. Gary represents clients in appeals before the Trademark Trial and Appeal Board, in petitions to the Director of the USPTO, and in disputes involving infringing domain names.
Gary also represents clients in a range of IP and commercial litigation, from trademark and patent infringement disputes to matters involving nonpayment for goods or services, construction lien enforcement, and misappropriation of funds held in trust under the Michigan Construction Lien and Builders Trust Fund Acts. He pursues collection of judgments entered in his clients’ favor and has negotiated numerous favorable settlements on their behalf.
