In this session, Tim explores how digital health and AI companies embed telehealth features to lawfully access patient data through consent, bypassing CPOM restrictions via MSO/PSA structures.   • Charting the Future: Legal Considerations for Healthcare Professionals in the Age of AI, presented by John Howard, Senior Attorney, Cybersecurity and Data Privacy. As AI becomes more prevalent in healthcare, legal frameworks are racing to keep pace. John will discuss federal and state efforts to regulate AI, including the OCR’s current stance and inter-agency initiatives to promote safe adoption. John will also highlight emerging state laws, such as those in Texas, and explore how existing regulations are applied to new AI tools. Attendees will gain a legal roadmap for navigating the future of AI in healthcare.
  • From Information Blocking to Sharing: Operationalizing the 21st Century Cures Act in Hospitals and Clinics, presented by Paul Schmeltzer, Member, Cybersecurity and Data Privacy. Despite the 21st Century Cures Act mandates, many providers still engage in behaviors that amount to information blocking. Paul will guide attendees through identifying risky practices, implementing “share by default, secure by design” workflows, and applying exceptions appropriately. This session offers practical strategies for compliance, documentation, and oversight readiness—ensuring data flows efficiently while minimizing legal and reputational risks.
  • Summary of 2025 Government Healthcare Investigations, Enforcement Actions and Anticipated Priorities for 2026, presented by Laura Reilly O’Hara, Member, Healthcare and Crane Pomerantz, Member, Litigation. In this session, Laura and Crane will examine key federal enforcement actions from 2025, including major DOJ and HHS-OIG investigations targeting Medicare Advantage fraud, improper billing practices, and violations of the False Claims Act. Attendees will gain insights into the DOJ’s new White-Collar Enforcement Plan and the evolving role of whistleblower programs, as well as CMS’s updated compliance priorities for 2026, such as enhanced scrutiny of in-home health risk assessments and improper drug payments. The session will conclude with practical guidance on preparing for heightened regulatory oversight and aligning organizational compliance strategies with anticipated enforcement trends.

Plus, we’ll host a panel of healthcare executives who will explore the sweeping impact of Texas’s new non-compete law (effective September 1, 2025), which limits physician non-competes to one year, five miles, and capped buyouts. We will discuss how these reforms reshape physician retention strategies, care continuity, and market competition. Drawing from real-world experience, panelists will share insights on balancing contractual obligations with patient care responsibilities, offering guidance to executives, legal counsel, and clinical leaders navigating this evolving landscape.
