In addition to his Real Estate practice, Eamonn also has 20 years of post-qualified banking experience and in-depth specialist knowledge of real estate finance, secured lending, and enforcement matters. He originally trained and worked in a boutique Dublin banking law firm specializing in real estate finance and has since worked in a similar capacity with large Dublin and Belfast firms, most recently with HBMO before its merger with Clark Hill. Eamonn has served institutional banking clients, overseas property investment funds, insolvency practitioners, local authorities, bespoke lenders, and borrower-developer clients. His experience includes drafting, reviewing, and negotiating facility letters, mortgage deeds, debentures, deeds of subordination, guarantees, board minutes, corporate certificates, security reports, and related finance and security documentation. He also advises on company law matters affecting corporate borrowers, including corporate authority, constitutional matters, and the application and use of the Summary Approval Procedure in connection with the granting of security. Eamonn regularly advises on cross-border real estate finance transactions, including coordinating and agreeing foreign legal opinions on security issues, and on consumer credit matters where they arise.
Eamonn advises clients through all stages of banking transactions, with a particular focus on the funding and acquisition of development land, licensed premises, residential property, including apartment blocks and student housing, and commercial real estate, including office blocks, petrol stations, food waste processing plants, and bioenergy plants. He also advises financial institutions and insolvency practitioners on security enforcement, including letters of demand, appointment of receivers, receiver sales, powers of sale under security documentation, work-outs, asset disposals, sales of distressed assets, and restructuring.
Representative Real Estate Finance Experience
- Represented a corporate borrower-developer client in drawing down €7 million in development finance for a residential development
- Represented a domestic lender in the advance of €15 million in loan facilities for the acquisition of a commercial real estate portfolio
- Represented an international funder in advising on security in a cross-border transaction involving the acquisition by a corporate borrower of distressed Irish assets, including distressed real estate, in the amount of €30 million
- Completed large-scale, project analysis of security held by a foreign lender in Ireland prior to a loan sale of €150 million
