Renee Diaz

Renee Diaz litigates complex commercial disputes with an emphasis on construction and insurance coverage. Design professionals, owners, contractors, businesses, and insurers rely on Renee’s counsel to guide them through conflicts involving contract and business disputes, lien claims, construction defects, and professional liability matters.

Renee focuses her practice in construction and business disputes, regularly counseling architects, engineers, owners, and contractors in a range of construction law matters. She also counsels clients in real estate and commercial disputes, advising businesses on risk exposure and risk management.  Her experience includes representing clients in high-dollar disputes in trials, arbitrations, and mediations that involve matters ranging from contract disputes, delay claims, unforeseen site conditions, payment remedies, licensure, and claims of defective design or construction.

She has secured favorable judgments and settlements for her clients in actions including preparing and arguing successful summary judgment motions in complex cases. Among her notable engagements was demonstrating that a multi-million dollar subrogation mold claim against the project architect was negated by the doctrine of superior equities as the general contractor failed to properly install antimicrobial flooring material, spurring a settlement in the low five figures, and achieving the early dismissal of a law firm and attorneys through summary judgment from a case involving a freelance paralegal’s claim that the law firm was obligated to pay for the paralegal’s fees for services despite a written contract obligating such fees be paid by the firm’s client, a dismissal that held up on later appeal.

Renee also has extensive experience working with insurers, assisting with first- and third-party claims including property and casualty claims, as well as construction and personal injury disputes.  Her practice includes writing coverage opinions and interpreting policy language.

Prior to joining Clark Hill, Renee represented corporate defendants, including Fortune 100 and 500 companies, in product liability, breach of contract, catastrophic personal injury, warranty, and commercial litigation matters.
