Marcus Graham

Senior Counsel

Marcus Graham is a seasoned litigator with more than 15 years of experience representing employers in complex labor and employment matters. Marcus focuses his practice on defending employers against claims involving discrimination, harassment, retaliation, wrongful termination, and wage and hour violations.

Prior to joining Clark Hill, Marcus served as Senior Trial Counsel for the U.S. Department of Veterans Affairs Office of General Counsel, where he led the litigation and resolution of a wide range of employment disputes. He has represented management in more than one hundred administrative hearings and played a leading role in defending the Department in more than 20 class-action wage and hour grievances with claims exceeding $600 million. Marcus also worked extensively with the U.S. Department of Justice in defending high-stakes litigation under Title VII, the ADEA, FLSA, and related statutes.

Marcus is a trusted advisor to senior leadership, known for developing practical strategies that mitigate legal risk and improve operational efficiency. He has negotiated changes to collective bargaining agreements, conducted nationwide training on federal pay systems and employment law, and served as a Special Assistant U.S. Attorney in the District of Delaware. He has also mentored attorneys and contributed to the development of litigation best practices within his former agency.

Earlier in his career, Marcus was a Presidential Management Fellow and served in advisory roles to the Principal Deputy Under Secretary for Health, providing strategic guidance on disciplinary and employment matters across the Veterans Health Administration.
