Jennifer Fay advises in relation to bankruptcy, restructuring, and corporate insolvency.

Personal Restructuring and Bankruptcy:

Jennifer advises individuals on personal debt and restructuring matters to include informal restructuring, negotiation with creditors and the more formal processes of Debt Settlement Arrangements, Personal Insolvency Arrangements and Bankruptcy. Jennifer also defends individuals in Court Applications brought by Creditors seeking to enforce debts allegedly due.

Having represented the Official Assignee in Bankruptcy for in excess of 20 years, Jennifer also advises in relation to post-bankruptcy matters such as bankruptcy extension applications, applications in relation to family homes and asset recovery litigation.

Corporate Restructuring and Insolvency:

Jennifer also advises corporates in relation to the duties and obligations of directors, solvency tests and the informal and formal restructuring processes available. She has worked with high street retailers, hoteliers, gyms and car rental companies in Examinership and Liquidation applications. Company directors have also engaged Jennifer in relation to the defence of fraudulent and reckless trading applications, applications in respect of asset transfers and applications for restriction or disqualification. Jennifer has also worked with Liquidators, Receivers and Examiners appointed to insolvent companies.

Commercial Litigation:

Jennifer represents both Plaintiffs and Defendants in respect of contractual disputes, investment disputes, debt related litigation and enforcement of security and personal guarantees. She has acted on behalf of individuals and companies in the High Court, Commercial Court, Court of Appeal and at Mediation.

Jennifer Fay serves as the Deputy Member in Charge for the firm’s Dublin office.
