James “Jay” J. Fleming represents clients in civil litigation, construction litigation, commercial litigation, real estate, environmental, and political law matters. His clients range from individuals, businesses, municipalities, and nonprofits.

Jay was a member of the trial team that recently achieved victory for Detroit Black voters in Agee, Jr. et al v. Benson et al, 1:22-CV-00272 (W.D. Mich). On December 21, 2023, the federal three-judge panel declared 13 Michigan Senate and House districts in the Detroit area racially gerrymandered and unconstitutional under the Equal Protection Clause.

Jay routinely represents and achieves client success in Michigan federal and state courts, including at the district, circuit, and Court of Claims level. This client success in the courtroom includes awards of summary disposition and judgment awards. Jay also wins for clients without having to go to court by negotiating settlement agreements that give clients the desired outcome while mitigating time and costs.

Jay was formerly a law clerk to Michigan Court of Appeals Judge Michael J. Riordan and Jackson County Circuit Court Judge John G. McBain.
