Datev ‘Dave’ Shenian is Senior Counsel in Clark Hill’s Litigation practice. His practice focuses on business and commercial litigation, with emphasis on commercial law, trade secrets, business fraud, unfair business practices, contracts, real estate and creditor’s rights.

Shenian’s experience includes pre-trial litigation, trials, and appeals in state and federal courts, judicial and private arbitration, mediation, and administrative proceedings in matters ranging in size upwards of multimillion-dollar disputes. Shenian’s clients include financial institutions, manufacturers, distributors, wholesalers, service providers, professionals, real estate investors, and others.

Through his extensive experience, Shenian has successfully represented his clients in complex contract and commercial disputes which were accompanied by business fraud and unfair practice claims, claims of breach of fiduciary duty and intentional interference with business relations. With technology having become an invaluable resource for businesses, large and small, Shenian has developed a core practice focus on misappropriation of trade secrets. Technology has made it easier for competitors, employees, insiders and others to access and acquire highly confidential and proprietary information which can be used to unfair compete against the owner of the trade secrets.  This trend has also been accompanied by another, employers and businesses who sometimes overreach in charging former employees and others with misappropriation of trade secrets, raising concerns about restraint of trade, unlawful in California. The COVID-19 pandemic is likely to increase litigation over misappropriation of trade secrets, as working from home has become the norm. Furloughs and layoffs have created perverse financial incentives to steal data despite cybersecurity measures, and innocent access or use of electronic data for work is misconstrued as misappropriation. Shenian is well-poised to help clients on both sides of these claims as they arise.

Shenian graduated cum laude from the University of California, Los Angeles with a Bachelor’s of Arts in Psychology and also obtained his Juris Doctor degree from the University of California, Los Angeles, School of Law. Shenian is committed to helping clients by providing them with efficient, creative, and effective representation to resolve their legal matters. Intelligently aggressive in litigation, he strives to maximize the results for his clients.

Shenian has developed extensive experience, first at a Beverly Hills boutique firm where he quickly assumed a supervisory role, mentoring associates. He then served a broad array of institutional clients at a prestigious firm with a 100-year plus history. Adopting a more entrepreneurial approach to his professional practice, Shenian became president and principal attorney at Shenian Law Firm, a firm he established in April 2006. His firm represented a broad range of clients from Fortune 500 companies to small and middle-sized companies and entrepreneurs. Prior to joining Clark Hill, and after a decade of heading his own firm, Shenian continued his practice at a fast-growing mid-sized firm. Shenian complemented his experience as an advocate by serving as an arbitrator as well as temporary judge in Los Angeles Superior Courts.

When he’s not litigating, Shenian enjoys spending time with his family, basketball, music and following current events.
