Tackling the Overlap Between the FMLA, ADA, and WC
The FMLA, ADA, and state workers’ compensation statutes all protect employees who need to take time off from work because of medical, disability, or family issues. These laws intersect and overlap, and in some cases, all three may protect an employee. Join Stephanie Rawitt as she uses a hypothetical employee situation to explore the impact of these statutes as well as strategies for navigating difficult performance and termination decisions when they arise while an employee is on job-protected leave. This session will also explore retaliation claims that can arise in conjunction with protected leave and identify best practices for avoiding liability exposure.
