Jonathan Crumly

Jonathan D. Crumly represents companies in the ERISA group health plan industry, assisting them in navigating this highly regulated space. Jonathan has significant experience litigating for clients against the US Department of Labor, Employee Benefits Security Administration. His work includes defending claims brought by EBSA and pursuing claims against EBSA on key regulatory and legal issues. Jonathan leverages his three decades of complex litigation and government relations experience to provide comprehensive strategies to navigate business and regulatory disputes in this arena.​

Currently, Jonathan serves as the lead counsel for several businesses at the forefront of groundbreaking litigation against EBSA. If successful, the litigation will establish the validity of a novel structure for ERISA group health plans, which could benefit millions of independent contractors and sole proprietors. This litigation has been ongoing for over six years on numerous fronts.

​Jonathan has tried many cases over his career, both as jury and non-jury trials. In addition, he has substantial experience in many forms of alternative dispute resolution, successfully mediating over 400 disputes. Jonathan has won arbitration awards as large as nearly $8,000,000 and a $7,400,000 jury verdict. That verdict was the second largest commercial litigation jury verdict in Georgia that year.

In addition to his litigation and dispute resolution experience, Jonathan was General Counsel for a 1,300-acre mixed use sports-vacation destination development in Bartow County, Georgia. In his role as General Counsel, Jonathan oversaw all legal needs of this ambitious, complex development that has become the premier travel and youth sports destination in the country. It is home to several world-class amateur sports venues as well as retail, restaurant, and hospitality locations. He has also counseled numerous construction industry clients in drafting and negotiating all forms of agreements for construction projects, utilizing nearly every form of project delivery system. He was counsel to a university housing development company in the southeast on multiple student housing projects totaling over $100,000,000 in development budgets. In representing youth sports development project, he negotiated design and construction management agreements with aggregate development budgets exceeding $110,000,000 as well as a public-private partnership bond closing of $36,000,000.
