October 15, 2020

Many businesses subject to U.S. Environmental Protection Agency (EPA) regulations continue to face uncertainty as they navigate environmental compliance and enforcement issues due to COVID-19. EPA and numerous state counterparts have issued policies and guidance on their intent to exercise enforcement discretion during this unique time, but these policies have raised as many questions as they’ve answered, including:

• Are businesses guaranteed immunity from penalties or prosecution?
• As in-house counsel or environmental, health, and safety (EHS) professionals, what are our options?

Fortunately, businesses have several options that extend beyond these temporary policies, but each must be evaluated carefully for its applicability and associated conditions.

Join Joe Brendel, Danielle Hazeltine, and Maram Salaheldin of Clark Hill’s Environment, Energy, and Natural Resources group for a presentation to gain a better understanding of these new and existing policies, as well as answers to your pressing questions.
