Clark Hill attorneys Linda M. Watson and Mariah S. Mumford were recently published in the Michigan Bar Journal. Their article, “Threading the Needle: A Guide to Reasonable Certainty in a Lost Profits Case,” appears in the Journal’s January 2020 Business Litigation theme publication. The article discusses different theories available to compute lost profits in a commercial dispute, explores the application courts have taken in evaluating the reasonable certainty of calculations, and provides best practices to increase the likelihood of success at trial.

Linda M. Watson is an Equity Member at Clark Hill PLC in the Litigation Practice Group. She is also a member of the firm’s Executive Committee and co-chair of its Automotive & Manufacturing Industry Business Unit. She has more than 25 years of complex litigation experience representing small to large privately-held business entities, as well as public corporations both at the trial and appellate levels of federal and state courts.

Mariah S. Mumford is an Associate at Clark Hill PLC in the Litigation practice group. She focuses her practice in the areas of commercial litigation, products liability, intellectual property, and entertainment law.
