After years of regulatory and litigation controversy, the Environmental Protection Agency and U.S. Army Corps of Engineers have proposed for public comment a rule defining the scope of waters regulated under the federal Clean Water Act or by states with approved programs. The new proposal differs dramatically from previous approaches. Comments are due by April 15, 2019.

Clark Hill environmental and regulatory attorneys will provide a summary of what is proposed, discuss important changes from the current regulatory definition and the practical implications for your operations, and what all this means for states interested in pursuing Clean Water Act Section 404 regulatory authority.   In addition, we will provide key guidance on how to develop meaningful comments that can be used by the agencies to justify and defend the rule in the likely event the rule is challenged in court.  .
