Clark Hill Attorney Scott Cruz Appeared on WLS AM 890 to Discuss Sexual Misconduct in the Workplace
CHICAGO, IL – Scott Cruz, Senior Counsel in Clark Hill’s Labor and Employment Practice Group, recently appeared in a segment on WLS AM 890 featuring “Big John” and “Ramblin’ Ray” to discuss workplace harassment.
Scott discussed vetting processes for companies to go through to avoid going straight to court to sue for sexual harassment. He stated that here in Illinois, one would have to visit either the Department of Human Rights and Equal Opportunity Employment Commission where they essentially vet these types of claims prior to going to court. He also stressed the importance of companies having a policy against harassment and/or implementing training regarding these types of issues.
When asked by one of the featured hosts of the segment how the current environment could change how judges or juries view these types of situations, Scott replied, “that is to be determined, but I think what we would see when these claims actually get to a jury is that a lot more employers are going to be hit with bigger verdicts. Juries now are going to look at their own experiences and make sure this isn’t going to happen again. This is why, for employment cases, that 1 percent of them actually get to a jury.”
