Clark Hill Attorney Scott Cruz Appeared on Business First AM to Discuss Sexual Harassment Claims and Labor Law Issues
CHICAGO, IL – Scott Cruz, Senior Counsel in Clark Hill’s Labor and Employment Practice Group, recently appeared in a segment on Business First with Angela Miles to discuss workplace harassment claims and cases, as well as other labor law issues.
Scott relayed the proper timeline of events that should take place once an alleged incident has occurred, prior to making a case. This timeline would include filing a complaint according to the company procedure of the company where the alleged incident occurred; informing a supervisor of misconduct; and obtaining counsel if necessary. Scott also mentioned that while only 1 percent of cases will go to a jury, many sexual harassment cases will settle out of court.
Scott continued to discuss other labor law issues, such as a Sam’s Club suddenly closing, rendering its employees unemployed. When asked by Angela Miles whether the employees had any recourse, Scott answered, “Unfortunately, they don’t. They’re employees at will, and under that concept a company can take any action.” Scott suggested a course of action that an at will employee in this situation could take, which is to apply for unemployment due to being laid off.
