BIRMINGHAM, MI – Clark Hill attorney Anne-Marie Vercruysse Welch will present “Confidentiality, Waivers and Similar Settlement Agreement Provisions Under Scrutiny: Tell Me About Your Separation Agreement” at the American Bar Association’s 10th Annual Labor and Employment Law Conference on November 12, 2016, at the Sheraton Grand Hotel in downtown Chicago, Illinois.
Increasingly, enforcement and regulatory agencies are challenging confidentiality provisions as part of settlement or release agreements. Welch will speak on a panel about whether certain waivers of rights, confidentiality, nondisparagement and covenants not to sue or cooperate are valid in light of recent decisions by the courts as well as actions taken by agencies such as the EEOC, SEC and NLRB. The panel will review the state of the law as well as explore best practices to avoid further disputes about these types of provisions.
