Joel D. Applebaum

Joel D. Applebaum is co-leader of the firm’s Corporate Restructuring and Bankruptcy Practice Group, concentrating his practice in the areas of bankruptcy and corporate reorganization, creditors’ rights and bankruptcy-related litigation and appeals, and general commercial law.

Joel has broad experience representing debtors, creditors’ committees, customers, trade vendors, purchasers of distressed assets, liquidating agents and trustees, among other parties in interest, in Michigan and in bankruptcy courts throughout the United States and in all industries and business types. He has successfully argued cases in the United States Court of Appeals for the First, Third, and Sixth Circuits, including United Food & Commercial Workers Union v. Almac’s, Inc. (In re Almac’s, Inc.), 90 F.3d 1 (1st Cir. 1996) and Bayer Corp. v. MascoTech, Inc. (In re Autostyle Plastics, Inc.), 269 F.3d 726 (6th Cir. 2001). Joel also is highly experienced in state law creditors’ rights procedures, including assignments for the benefit of creditors, receiverships and trust mortgages.

Some of Joel’s representative engagements include:

  • Counsel to the Official Committee of Unsecured Creditors of Plastech Engineering Products, Inc. (Detroit, Mich.), a large Tier 1 automotive parts supplier with annual revenues of approximately $1.4 billion
  • Counsel to the Official Committee of Unsecured Creditors of Greektown Holdings, Inc. (Detroit, Mich.), one of three Detroit, Mich., based hotel and casino gaming complex with annual revenues of approximately $300 million
  • Counsel to the Litigation Trustee of the Greektown Litigation Trust in the prosecution of a multi-million dollar fraudulent transfer action
  • Counsel to the chapter 7 trustee of NM Holdings, Inc., (f/k/a Venture Holdings Co., LLC), (Detroit, Mich.), a Tier 1 automotive parts supplier, in the prosecution of a multi-million dollar fraudulent transfer action
  • Counsel to several large Tier 1 automotive suppliers in the troubled supplier cases of General Motors Corporation (New York, N.Y.), Dura Automotive, Inc. (Wilmington, Del.), Delphi Corporation (New York, N.Y.), among others
  • Counsel to a large not-for-profit community mental health services corporation in the successful out of court restructuring of its secured and unsecured indebtedness

A member of the Michigan, New York, Washington and Federal Bar Associations, Joel also is a past co-chair of the State Bar of Michigan’s Creditors’ Rights Committee. He has authored numerous articles on bankruptcy and creditors’ rights topics for various continuing legal education organizations and the Wayne Law Review, and is a co-author of the chapter on creditors’ committees for the multi-volume bankruptcy treatise entitled “Chapter 11 Theory and Practice: A Guide to Reorganization,” published by LRP Publications. Joel is a Fellow of the American College of Bankruptcy, an honorary association of bankruptcy and insolvency professionals, and was selected as a leading attorney in bankruptcy and creditors’ rights by Best Lawyers in America (2011 through present), Michigan Super Lawyers (2007 through present), and dBusiness magazine (2009 through present).

Joel received his J.D., with honors, from Wayne State University Law School in 1983, and his B.A., with honors, from Michigan State University in 1979, after completing a two-year study term at the Ohr Somayach College of Judaic Studies in Jerusalem, Israel.
