Conal O'Doherty

Associate Solicitor

Conal O’Doherty advises commercial entities, as well as debtors and creditors in relation to a variety of litigation matters with a focus on insolvency, restructuring, and bankruptcy. He provides advice to clients in respect of both contentious and non-contentious matters.

Conal’s experience includes working across broad ranges of litigation including contentious construction matters and defending a wide array of professional indemnity claims. This has entailed advising on a number of high value, complex, international litigated disputes.

Commercial Litigation and Dispute Resolution

  • Advising a varied client base which includes government bodies, corporate bodies and insolvency practitioners on both contentious and non-contentious corporate recovery and insolvency matters, as well as the restructuring of disputed debts;
  • Acting for both Plaintiff and Defendants in multiple case across the High Court, Commercial Court Division of the High Court and the Court of Appeal;
  • Advising clients, both Plaintiff and Defendant in respect of contractual disputes/investment disputes/disputes arising out of the interpretation of financial instruments and Guarantees;
  • Extensive involvement in multiple large bankruptcy estates and the multi-jurisdictional litigation arising out of these;
  • Acting for a Liquidator in a series of Court Proceedings arising out of preferential repayments and illegal asset disposals to linked companies and parties.

Insolvency

  • Interpreting, analyzing, and advising clients on relevant case law, legislation, and the practical business implications arising from said advice.
  • Involved in hearings before Financial Services Ombudsman the subject matter of which was a financial product which was not in line with the product anticipated by the Plaintiff.
  • Acting for and advising a Defendant as against the Revenue in a case which has developed a new legal precedent in Bankruptcy regarding contingent liabilities and pre-adjudication debts.
  • Acting for a Liquidator in a series of Court Proceedings arising out of preferential repayments and illegal asset disposals to linked companies and parties.
  • Advising a varied client base which includes government bodies, corporate bodies, and insolvency practitioners on both contentious and non-contentious corporate recovery and insolvency matters, as well as the restructuring of disputed debts;
  • Advising debtors in disputes with banks and other financial institutions as to restructuring and as to legislative protections. Including liaising with financial institutions and Personal Insolvency Practitioners on behalf of clients with a view to facilitating consensual restructuring of debts;
  • Experience in advising Liquidations and Receivers in relation to a wide range of contentious and non-contentious issues.

Conal serves on Clark Hill’s Leadership Forum as representative for the Dublin office, a group which is responsible for creating opportunities and programming to support the professional goals of Clark Hill’s associates and senior attorneys.
