Clark Hill Real Estate Team Assists in Planned Unit Development Agreement Negotiation in Oakland County

Oakland County, Michigan –

The Real Estate Team of Clark Hill PLC negotiated a Planned Unit Development (PUD) Agreement between the developers of Magnolia by the Lakes, a luxury assisted living facility, and the City of Keego Harbor. The PUD was finalized in record time, with less than one month passing between the first Planning Commission meeting and approval of the final PUD contract and site plan by the City Council. The agreement was signed after multiple special sessions to review and approve the contractual language.

Clark Hill Attorney Stephon B. Bagne handled the negotiations on behalf of the developers.

“Complex agreements can only be negotiated this quickly if the attorneys act as facilitators, not obstructionists, by drafting fair language that anticipates the reasonable needs of both their own client and the other party, “ Bagne said. “Substantive areas of disagreement will arise but they can be bridged if the attorneys are not needlessly posturing. The City, including the Mayor, Council, Planning Commission, Clerk, consultants and attorneys worked diligently to welcome this project into their community.”
