Clark Hill Attorneys Ray J. Koenig III and MacKenzie A. Hyde Presented “Dealing with Behavioral Disorders Exhibited by Clients and Beneficiaries” for the Greater North Shore Estate & Financial Planning Council

CHICAGO, IL – Clark Hill attorneys Ray J. Koenig III and MacKenzie A. Hyde presented “Dealing with Behavioral Disorders Exhibited by Clients and Beneficiaries” for the Greater North Shore Estate & Financial Planning Council at their bimonthly membership meeting on March 16, 2016 at the Highland Park Country Club in Highland Park, Illinois.

The presentation provided estate and financial planners with an overview of how their practice may be affected by a client or beneficiary who may suffer from some sort of “behavioral disorder.”  The issues that may arise in this context include the capacity to:  (i) execute documents; (ii) accept a beneficial interest in an estate or trust; and (iii) serve as a fiduciary.  The presentation included practice pointers with regard to how to manage–and avoid–conflicts that the presenters have seen arise when dealing with a client or beneficiary with a “behavioral disorder.”

Koenig is a member in Clark Hill’s Litigation and Personal Legal Services Practice Groups. He also serves in leadership roles within the firm, which includes serving as the Managing Member of Clark Hill’s Chicago office and on the firm’s Executive Committee. Koenig is a fellow of the American College of Trust and Estate Counsel (ACTEC) and serves as a member of its Fiduciary Litigation Committee. He has represented individuals, families, financial institutions, medical institutions, and governmental organizations in all areas of his practice.

Hyde is a Senior Attorney in the Litigation Practice Group of Clark Hill’s Chicago office. Hyde concentrates in contested guardianships and estates as well as fiduciary litigation and estate administration. She represents individuals, medical institutions and financial institutions in all areas of her practice. Hyde is frequently appointed by judges in the Probate Division of the Circuit Court of Cook County to serve as a Guardian Ad Litem in disabled estates and Special Administrator in decedents estates.
