Clark Hill Attorneys Paul Magy, Timothy Koltun, Richard Sundquist, David Blau, and Matt Heron Presented at the ICSC 2013 Michigan Continuing Education Program “Made in Michigan: The New Age of Retail” – Feb. 13

Clark Hill Attorneys Paul Magy, Tim Koltun, Richard Sundquist, David Blau and Matt Heron participated in “Made in Michigan: The New Age of Retail”, ICSC’s 2013 Michigan Continuing Education Program for Real Estate Professionals. Paul Magy is a Past State Director of ICSC and is the overall Program Planning Chairman for this Program that included a faculty of 50+ experts on 30+ retail real estate subjects. Magy coordinated this program with the Michigan State Bar Real Estate Section, Special Committee on Commercial Leasing. It was the best attended and highest profile credentialed program for shopping center professionals in the state and provided 6.0 hours of CRE credits, including credits for the state of the art legal update on commercial real estate issues. Blau and Heron participated in the “Understanding the Issues in Retail Real Estate” section of the Program and discussed, “Landlord-Tenant Crossfire Arising Out of Troubled Tenancies: Run for Cover”. Koltun and Sundquist discussed, “Tenant Strategies for Addressing CAM Provisions of Leases and Landlord Responses–Avoiding the CAM Shaft.”


The program was held at Suburban Collection Showplace in Novi, Mich.


Magy is a member of the firm’s Real Estate Practice Group. He possesses extensive commercial real estate experience, which includes acquisition, development, finance, zoning, leasing and sale of commercial real estate, in addition to litigation experience in receiverships, distressed assets and retailer bankruptcy. Magy is an active member of a number of community organizations, including president of the Building Owners and Managers Association (BOMA) of Metropolitan Detroit and member of the International Council of Shopping Centers (ICSC). He was awarded ICSC’s highest honor, the Trustees Distinguished Service Award, and is currently chair of Michigan’s ICSC Continuing Education Program for Real Estate Professionals. Magy received Martindale-Hubbell’s highest possible rating in 2012, AV Preeminent®.


Koltun is a member in Clark Hill’s Detroit office and the leader of the firm’s Real Estate Practice Group. His extensive experience in real estate law includes sales, acquisition, development, and leasing of residential, retail, office, industrial and hotel projects. In addition, Koltun has significant experience in forming limited liability companies, and drafting and negotiating operating agreements for real estate projects. He is named in Best Lawyers, Michigan Super Lawyers and Chambers USA: America’s Leading Business Lawyers. Koltun also is one of the few Leadership in Energy and Environmental Design (LEED) Accredited professional attorneys nationwide.


Sundquist is a member in the firm’s Detroit office where he practices in the Business Practice Group. He practices primarily in the areas of real estate, bankruptcy, general business and real estate related environmental law. In addition to providing transactional services in these areas, he has significant litigation experience (bench and jury trials) in state and federal courts, including the bankruptcy courts.


Blau is an associate in the firm’s Birmingham office where he practices in the Real Estate Services Practice Group. He works primarily in the areas of real estate transactions, real estate litigation, landlord-tenant, bankruptcy/creditor’s rights, general business and healthcare matters. David has significant litigation experience in state, federal, and bankruptcy courts.


Heron is a Senior Attorney with the Litigation Practice Group of Clark Hill’s Detroit office, focusing in the area of commercial litigation. He has significant litigation experience in transportation, real estate, landlord-tenant, warranty, property insurance, title insurance, and large commercial disputes. Prior to joining Clark Hill, Matthew was a law clerk for two years to the Honorable Lawrence P. Zatkoff, Chief Judge of the United States District Court for the Eastern District of Michigan.
