Clark Hill Attorney Scott Cruz Appeared on Fox 32 Good Day Chicago Broadcast
CHICAGO, IL – Scott Cruz, Senior Counsel in Clark Hill’s Labor and Employment Practice Group, recently appeared on local Fox 32’s Good Day Chicago broadcast. Cruz discussed how social media postings can have an adverse effect on employers, in particular, when employees are publicly voicing opinions on current events.
“Free speech only applies to public sector employees: city, state, and local government employees. Private sector employees . . . do not have a first amendment right,” said Cruz.
In response to the recent Jason Van Dyke trial verdict, Good Day Chicago host Sally Schulze asked Cruz whether employers would be looking at employees’ reactions to the trial and verdict on social media, to which Cruz responded, “There’s a fine line of demarcation. If it comes to their attention, they have a tough decision to make on what it is they have to do.”
