Clark Hill Attorney Charles Berry to Present on Creating Alternative Dispute Resolution Provisions at the Monthly Scottsdale Bar Association Meeting
PHOENIX, AZ – Clark Hill attorney Charles Berry will present on Creating Alternative Dispute Resolution Provisions, along with local mediator/arbitrator Dave Tierney, at the monthly Scottsdale Bar Association meeting on Tuesday, June 9, 2015 at the Gainey Ranch Golf Club in Scottsdale, Arizona.
Recent Supreme Court and other appellate court cases have consistently enforced alternative dispute resolution procedures in business, employment and consumer situations. Lawyers often include arbitration clauses without much thought about the substantive and procedural issues that may arise. Two veteran practitioners in arbitration and business law will examine the practical aspects of deciding whether or not alternative dispute resolution is beneficial in particular situations, and creating effective and enforceable mediation and arbitration provisions. They will also discuss dealing with some “arbitration clauses from hell.”
Berry represents corporations, limited liability companies, partnerships, other business entities and individuals in a wide spectrum of transactions, focusing primarily on capital formation, business management and real estate. In addition to debt and equity financings, he has represented securities dealers, their registered representatives, and registered investment advisers in connection with regulatory compliance matters and investigations. Berry has participated in many Financial Industry Regulatory Authority (FINRA) arbitrations, serving as an arbitrator as well as representing claimants and respondents, and conducting arbitrator training for FINRA. He has extensive experience in securities regulation, public offerings, business mergers, acquisitions and sales, private placements and compliance with the periodic reporting requirements of the Securities Exchange Act of 1934. In addition to debt and equity financings.
