Timothy M. Koltun's practice is devoted almost entirely to matters involving real estate. Timothy is the Practice Leader for Clark Hill's Real Estate Services Practice Group.
He has extensive experience in the sale, acquisition, development and leasing of residential, retail, office, industrial and hotel projects. Timothy has represented clients in complex sale/leaseback transactions involving commercial properties located in several states, and projects involving the utilization of tax credits and public and quasi-public funding. He has also represented institutional lenders as well as commercial borrowers in connection with construction and permanent financing, including mezzanine and securitized loans, and workouts, restructuring and enforcement of troubled loans. Timothy has significant experience in forming limited liability companies and drafting and negotiating operating agreements for real estate projects. He has substantial expertise in the negotiation and documentation of design and construction related contracts, both from the contractor’s and owner’s standpoint. Timothy has represented numerous clients with respect to attached and site condominium projects as well as traditional platted projects.
Timothy is named in Best Lawyers in America and Super Lawyers in Michigan. Timothy is one of the limited number of attorneys nationwide who is a LEED Accredited Professional.
