Jennifer J. Sackett Pohlenz is in Clark Hill’s Chicago office. She is a Senior Attorney in the Environment, Energy and Natural Resources and Litigation groups. Jennifer works with local governments, private and publicly traded corporations, and individuals in a wide array of environmental law issues. She is licensed in Illinois and Indiana, and represents clients in administrative actions, litigation, and transactional matters.
Jennifer has advised clients in matters including, but not limited to:
- common law litigation involving, most commonly, trespass and nuisance
- injunction and declaratory judgment actions involving environmental conditions
- litigation involving the state and federal constitutions
- administrative matters such as administrative citations and permitting
- alternative energy projects
- sustainable or green development
- the drafting of environmental ordinances
- the negotiation and drafting of host benefit agreements for new pollution control facilities, solid waste contracts, real estate contracts involving environmental issues, and highway authority agreements
- insurance coverage actions, involving coverage for environmental conditions at a site
Jennifer also regularly advises clients with respect to compliance with many of the federal and state laws and regulations, such as CERCLA, RCRA, AHERA, NESHAP, CAA, CWA, Endangered Species Act, EPCRA, and the Illinois Environmental Protection Act. Additionally, she continues to speak frequently on environmental and construction law matters.
