Court of Appeals Affirms Clark Hill Litigation Team's Trial Court Success

May 19, 2010

On April 20, 2010, the Michigan Court of Appeals issued a Per Curiam Opinion affirming the lower court's dismissal of a lawsuit initiated against one of the largest public pension funds in the country. The dismissal was obtained by Clark Hill litigation practice group members Joseph E. Turner, Jr. , Ronald A. King , and Jordan S. Bolton . In their briefing to the lower court and the court of appeals, the Clark Hill litigation team argued that Plaintiffs failed to exhaust their administrative remedies, and that the case should be dismissed. The trial court agreed, and, in a three page opinion, the appeals court adopted Clark Hill's arguments, and affirmed the dismissal.
