EXPERIENCE

HEALTHCARE LITIGATION AND BUSINESS DISPUTES

  • Represented healthcare entities in business disputes involving various aspects of federal and state healthcare law
  • Obtained summary judgment on behalf of healthcare entity in payment dispute with Medicaid contractor
  • Obtained favorable settlement on behalf of founding member of professional association in dispute over buy-out rights
  • Represented physicians in disputes with healthcare entities
  • Assisted physician clients in responding to Civil Investigation Demands
  • Represented out-of-network healthcare providers in payor disputes

COMMERCIAL LITIGATION & BUSINESS DISPUTES

  • Defended companies and their directors and officers against breach of fiduciary duty claims
  • Obtained temporary restraining order freezing significant funds in multiple bank accounts in civil fraud case
  • Represented various companies in connection with contractual disputes

BANKING LITIGATION

  • Served as Assistant General Counsel at Amegy Bank, N.A
  • Obtained summary judgments against defaulting borrowers and guarantors and defended against their counterclaims
  • Intervened in a lawsuit to obtain orders expunging four wrongfully filed lis pendens, thereby allowing the client bank to close on sales of properties valued at more than $900,000
  • Obtained a take-nothing judgment on behalf of banking client in an action governed by Chapters 3 and 4 of the Texas Business & Commerce Code
  • Represented a bank in court-ordered mediation proceedings during which the parties reached a settlement agreement requiring no financial contributions or significant concessions by the bank

PRODUCTS LIABILITY LAWSUITS

  • Served on Strasburger team that obtained a jury verdict in favor of manufacturer client in federal lawsuit
  • Prevailed on summary judgment in federal court case based on deficiencies in plaintiff?s expert testimony and lack of causation
  • Represented manufacturers in various types of products liability disputes
