Katie Anderson is a counselor and litigator passionate about representing governmental entities, including educational institutions, housing authorities, and special districts. Katie zealously guides governmental entities through a variety of challenges including:

EXPERIENCE

DESEGREGATION & DISCRIMINATION

  • Assisted the Dallas Housing Authority in negotiating and implementing An Agreed Final Judgment to end mandated court oversight in the Walker desegregation case.
  • Investigated and responded to charges of discrimInation (age, disability, race).
  • Granted summary judgment for housing authority in employment case claiming race discrimination under Title VII and 42 U.S.C. §1983. Motion was supported by evidence of poor work performance and personality differences.
  • Granted summary judgment for school district in DFW area for termination of receptionist in which the plaintiff alleged racial discrimination under Title VII. Motion was supported by proof that basis for the district's employment decision was poor work performance of the employee.

FIRST AMENDMENT & CIVIL RIGHTS

  • Handled civil rights allegations against school district which were dismissed prior to trial.
  • Represented school district in Office of Civil Rights investigation under Title IX and reached agreement for long-term bond proposal to build equal baseball and softball facilities
  • Obtained motion for summary judgment for school district and its superintendent and board members for alleged violations of First Amendment free speech rights of a parent.

GOVERNANCE

  • Regularly advises governing boards of governmental entities on complying with fiduciary duties, open government, and best practices for governance.
  • Drafted guidelines to increase diversity for community college district
  • Assisted educational institution in complying with The Family Educational Rights to Privacy Act

LEAVE

  • Counseled on use of leave and developed leave policies.
  • Drafted FMLA procedures and processes (requiring documentation from medical providers and steps to take before adverse job action).

IMMUNITY

  • Obtained non-suit for school district administrator based on summary judgment asserting official immunity.
  • Won summary judgment for a city based on sovereign immunity and limited waiver under §101.060 of the Tort Claims Act, which was upheld by Texas Supreme Court.
  • School District and its superintendent granted summary judgment based on sovereign immunity and official immunity for decision not to allow parent to attend class with elementary student and for alleged violation of parental rights in Education Code and Texas Constitution.

COMMERCIAL LITIGATION

  • Obtained motion for summary judgment for housing authority in breach of contract litigation in which applicant for CEO/President alleged he had been hired despite no evidence of a vote of the full board in a duly noticed and called meeting.
  • Obtained motion for summary judgment for city in Central Texas in breach of contract case regarding dispute over legal effect of vote taken by city council to move forward with land development project.
