Gina D. Shearer

Associate

Gina Shearer focuses her practice on construction and surety matters, with a particular emphasis on payment and performance bond obligations, bankruptcy, construction defect disputes, and enforcing rights against indemnitors. She also represents parties in complex commercial litigation in federal and state district and appellate courts, as well as before federal agencies.

Experience

Surety Litigation

  • Represents national contract and commercial sureties in complex litigation involving performance and payment bond obligations, bankruptcy, commercial bond matters, and pursuit of salvage opportunities

Construction Litigation

  • Represents contractors, developers, and sureties in multi-million dollar cases involving construction defects, liquidated damages, design defects, natural disasters, and environmental concerns

Commercial Litigation

  • Represents clients in matters relating to breach of contract, contract interpretation, employment disputes, Title VII claims, breach of fiduciary duties, and fraud

Administrative Law

  • Represents clients in matters involving the Internal Revenue Service and administrative proceedings before federal agencies

Transportation

  • Represents clients in matters relating to hazardous materials transportation, federal regulatory compliance, and energy

Commercial Bankruptcy

  • Represents secured and unsecured creditors in all aspects of Chapter 11, 7 and 13 proceedings and adversary proceedings, including challenges to discharge and dischargeability, with an emphasis on protecting and preserving creditors' rights and maximizing recovery
