Andrew Klimenko

Andrew Klimenko has over twenty five years of experience litigating a broad spectrum of matters including catastrophic personal injury/wrongful death, real estate, commercial, employment and insurance. Mr. Klimenko is a trained and certified mediator and has mediated dozens of cases to resolution. He has completed over fifty jury trials throughout the greater Bay Area with a success rate at better than 85%. In addition, he has served as a settlement panelist for the San Francisco Bar Association Early Settlement Program.

Representative Matters

  • Successful jury/bench trial defense of claim for a life estate interest in a San Francisco home valued in excess of $2.5M
  • Successful defense of trademark infringement/Lanham Act claim involving a well-known Bay Area trade mark in the U.S. District Court, Northern California
  • Published opinion overturning adverse jury verdict in case of first impression limiting recovery on claim for equitable indemnification – Union Pacific v. Wengert (2000) 79 Cal.App.4th 1444 (5 Witkin, Summary of California Law, p. 128, sec. 60 (10th ed. 2005).)
  • Successful defense of TIC investors in claim for equitable mortgage brought by developer and successful claim on cross-complaint for breach of the TIC agreement, securing binding arbitration award in excess of $1.2M (including fees and costs)
  • Obtained $2.45M settlement for elderly woman who sustained a catastrophic spinal injury following a fall on a public sidewalk with a significant “trivial defect” defense
  • Obtained confidential seven-figure settlement against commercial trucking company for catastrophic injuries sustained by bicyclist in an accident involving a big rig truck with significant liability defenses, including visibility and vehicle code violations
