Employee Benefits

Our employment attorneys counsel businesses and individual clients on employee benefits matters - including ERISA and Internal Revenue Code compliance for qualified plans and welfare plans, and also with regard to executive compensation. We deal with all types of qualified plans, including profit sharing, defined benefit, 401(k), money purchase, employee stock ownership, multi-employer and multiple employer plans. Clark Hill also assists clients in all areas of executive compensation, including non-qualified deferred compensation and incentive compensation (e.g., stock option plans, phantom stock plans and SERPs). Our expertise with regard to welfare plans and fringe benefit plans (cafeteria plans, flexible spending accounts, HRA's, severance plans and group health plans to name a few), rounds out our practice area. Our benefits practice is experienced in dealing with benefits issues particular to governmental entities and tax-exempt organizations, including 457 plans, 403(b) plans, and intermediate sanction rules.

We offer a complete line of employee benefit services. We regularly advise clients concerning drafting, negotiation, implementation, and planning with respect to benefits plans. We draft documents, prepare applicable governmental filings (IRS, Department of Labor or Pension Benefit Guaranty Corporation), assist with plan audits, and also with qualified plan correction program compliance.
