Guardianship & Conservatorship Administration

Guardianship and conservatorship administration is an ongoing process which requires constant communication between the client and his or her attorney on the changing needs of the ward. The attorneys that practice guardianship administration are invested in the well-being of the disabled individuals that their clients represent. Clark Hill’s goal is to make the administration of the disabled estate, which is often complicated and time consuming, as smooth as possible for the client. Guardianship administration includes, but is not limited to:

  • Analysis regarding the disabled person’s health and assistance coordinating the disabled person’s care plan
  • Analysis regarding the disabled person’s finances, including whether to seek authority to create estate planning documents, such as a special needs trust, on behalf of the disabled person
  • Petitioning the court for a change in placement for the disabled person
  • Petitioning the court for disbursements from estate funds for the benefit of the disabled person
  • Presentation of an annual account of the disabled person’s assets
