FTC Delays Enforcement of "Red-Flag Rules"

The Federal Trade Commission has announced a delay, until November 1, 2009, in enforcement of its "Red-Flag Rules" promulgated pursuant to the Fair and Accurate Credit Transactions Act.  The rules require certain businesses and government entities that defer payment for goods and services, including municipalities that operate public utilities (water, sewer and electric), to adopt and implement an identity theft prevention policy.  The FTC's announcement provides additional time to adopt and implement a policy.

If you would like to learn more about the FTC annoucement or the "Red-Flag Rules", contact Kenneth Lane at 616.608.1134 or klane@clarkhill.com or your Clark Hill Municipal Law attorney.
