Employment Counseling and Litigation

Tom advises employers in avoiding liability under various federal and state civil rights and employment laws. He defends employers in actions brought by employees including actions brought under the First Amendment, Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act (ADEA), the Americans With Disability Act (ADA), the Michigan Elliott-Larsen Civil Rights Act, the Michigan Persons with Disability Civil Rights Act, the Family Medical Leave Act (FMLA), the Workers Adjustment Retraining Notification Act (WARN) and various whistleblower statutes. He defends employers in employment contract and tort claims. He has represented clients before federal and state courts and administrative agencies in Michigan, Colorado, Florida, Georgia, Illinois, Iowa, Kentucky, Nevada, New Mexico and Ohio.

Traditional Labor Law

Tom advises employers on how to avoid union organizing campaigns. When employers are confronted by union organizing campaigns, Tom helps the employer design and execute successful campaign strategies to oppose the union's campaign. He litigates unfair labor practice charges before both the National Labor Relations Board (NLRB) and Michigan Employment Relations Commission (MERC). He acts as chief negotiator during collective bargaining negotiations. He advises employers on the administration of collective bargaining agreements, and the arbitration of grievances. He has represented employers with the Teamsters, SEIU, UNITEHERE!, Steelworkers, AFSCME and UAW.

Speeches and Publications

He has lectured on various employment issues including annual updates on current developments in labor and employment law, defense of First Amendment claims brought by employees, discovery and pretrial preparation in wrongful discharge and discrimination cases, obtaining summary judgment in discrimination actions, prevention of sexual harassment lawsuits, mandatory arbitration of discrimination actions, use of experts in discrimination actions, hiring practices, union avoidance, and negotiating collective bargaining agreements.

Tom's publications include 2002 through 2011 State of the Law, Employment and Labor Law, Federal and State; Sexual Harassment Law and Practice; Monitoring E Mail in the Workplace; Use of the "Same Actor" Inference and Arbitration of Civil Rights Actions. Between 1999 and 2005, he has acted as annual editor of the labor and employment issue of Laches, the monthly magazine of the Oakland County Bar Association.
